Please read these Terms of Service carefully before using Speedy Customs, operated by Ellipse Group LLC. By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By placing an order for custom apparel through our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy, and our Return and Rework Policy.
2. Custom Order Process and Finality
2.1 Digital Proof Approval
All custom orders require customer approval of a final Digital Proof before production begins. The Digital Proof confirms the artwork design, size, color, and placement on the garment.
- Customer Responsibility: You are solely responsible for verifying the accuracy of all details on the Digital Proof, including spelling, size, and design elements. Production will not begin until we receive your written or electronic approval.
2.2 Order Finality
Once the Digital Proof is approved, the order is considered final. Due to the custom nature of our products, changes or cancellations are severely limited after this stage.
- Cancellations: If a cancellation is requested after proof approval but before production, a fee may be assessed to cover costs incurred for materials or setup. Orders that have entered production cannot be cancelled.
3. Payment and Pricing
3.1 Pricing
Pricing is calculated based on the apparel style (Gildan lightweight/heavyweight), quantity (using price break points at 25, 50, 100, 150, 200 units), and the complexity of the printing method (DTG or Screen Printing).
- Quoted Price: The price provided in your final order confirmation includes the product cost, decoration cost, and applicable setup fees (for screen printing) and shipping costs.
3.2 Payment
All orders must be paid in full before production commences. We accept major credit cards and other forms of electronic payment as indicated on the Website.
4. Artwork and Intellectual Property Rights
4.1 Ownership of Artwork
You represent and warrant that you are the sole owner of, or have full legal permission to use, any artwork, text, logos, or designs ("Customer Content") submitted to us for printing.
- Indemnification: You agree to indemnify and hold harmless the Company from any claims, suits, or demands arising out of the use of your Customer Content, including claims for copyright, trademark, or intellectual property infringement.
4.2 Prohibited Content
We reserve the right to refuse any order containing content that we deem, in our sole discretion, to be infringing, libelous, defamatory, obscene, profane, or otherwise inappropriate or unlawful.
4.3 Company Rights
We retain the right to use samples of the finished product containing your Customer Content for promotional and advertising purposes, unless you explicitly request otherwise in writing at the time of order placement.
5. Production, Shipping, and Delivery
5.1 Production Time
Production time is an estimate, typically 7 to 10 business days from proof approval (or 3-5 days for DTG). We are not liable for reasonable production delays.
5.2 Shipping
We only ship to destinations within the United States. Shipping details are governed by our separate Shipping Policy. Risk of loss and title for all products pass to you upon our delivery to the shipping carrier.
5.3 No International Shipping
As clearly stated in our policies, we currently do not ship to international addresses.
6. Disclaimer of Warranties and Limitation of Liability
6.1 Warranty Disclaimer
We warrant that the products will be free from defects in materials and workmanship at the time of delivery. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED.
6.2 Limitation of Liability
In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or related to the products or services provided, even if we have been advised of the possibility of such damages. Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the specific custom apparel order in question.
7. Errors and Corrections
Any errors in your order must be reported within 7 days of delivery, as detailed in our Return and Rework Policy. Our sole obligation for verified production errors is to rework and replace the incorrect items. We do not issue full refunds for custom orders.
8. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of [Insert Your State Here], without regard to its conflict of law provisions.
9. Changes to Terms of Service
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our Website.
